This is a horrible bill because it interferes with the insured's right to select a contractor (and public adjuster) to make repairs. Citizens Property Insurance is really pushing this bill, because they HATE public adjusters, who often disagree with the repair estimates of the insurer.

I'm not suggesting that there has been no consumer harm in some cases where post-loss benefits have been assigned to "flight-by-night" scam artists. However, I would point out that:

1.      Public adjusters must be LICENSED (by Department of Financial Services); and,

2.      A just-released data call by the Office of Insurance (Mr. McCarthy) concludes that these is NO PROOF that an assignment of benefits is harmful to consumers; I have a copy of this report if anyone would like to see it.

Accordingly, I strongly recommend that we OPPOSE this bill in its current form, and ANY unreasonable restrictions on the contractual right to assign benefits.

Attached is a copy of Senate Bill #596, regarding limiting assignment of rights under insurance policies, that Ms. Miller was discussing on today's call. Our Committee should probably review this bill and analyze whether we want to propose taking a formal position on it with the Section/RP Division.  I'll go ahead and review it, and if anyone else is interested, let me know and we can exchange thoughts on it and consider how to proceed with informing the Division/Section at the upcoming Executive Council meeting next week.  If anyone has any additional questions for Ms. Miller regarding the matters she discussed today, please let me know and I can pass them along or put you in touch with her.

This is a reminder that, because our normally scheduled call falls on a holiday, our next monthly call is scheduled for Tuesday, January 19, 2016 - beginning at Noon.

Our CLE speaker on Tuesday will be Lisa Miller, CPM, who will speak about current insurance industry trends, including possible upcoming legislation or other agency action against bad faith claims.  Ms. Miller is the CEO of her company, Lisa Miller & Associates. Ms. Miller has served as Deputy Chief Financial Officer and Chief of Staff for the Florida Department of Financial Services, as Deputy Commissioner and Chief Lobbyist for the Florida Office of Insurance Regulation, and as Director of Corporate Relations for an Ernst & Young municipal bond investor relations affiliate. Ms. Miller was also the Office of Insurance Regulation's Board Liaison to many quasi-governmental entities including Citizens Property Insurance Corporation, The Florida Automobile Joint Underwriting Association, The Medical Malpractice Joint Underwriting Association, the Workers' Compensation Insurance Guaranty Association and the Florida Insurance Guaranty Association.  We will forward copies of Ms. Miller's materials in a separate e-mail prior to the call.
