Attached are copies of the Design Build Interamerican decisions from the
Eleventh Circuit I referenced on the call today.  There are two decisions
because the first one dealt with the excess policy and the second one with
the primary policy.  The second opinion merely recites the decision from the
first one.

Everyone: 

I hope you enjoyed your weekend and I apologize for circulating the agenda
so late but was out of town last week.  

Attached are the following for the monthly Insurance & Surety Committee
conference call scheduled for Monday, August 18, 2014 at noon: (1) agenda;
and (2) copy of the recent Order On Amended Motion For Summary Judgment in
the case styled: Florida Workers' Advocates (FWA) et. al v. State of Florida
Office of the Attorney General (August 13, 2014).

The FWA case is extremely significant in that Judge Jorge E. Cueto of the
Miami-Dade Circuit Court, ruled that Section 440.11, Florida Statutes, the
exclusive remedy provision in Florida Workers' Compensation Statute, is
unconstitutional.  Of course, if this decision is upheld, it changes the
landscape in Florida's workplace injury litigation and opens the doors
enumerable tort-based lawsuits impacting all of our clients.  There will
certainly be many groups scrambling to address this case legislatively and
the trial lawyers bar seeking to oppose such legislation. Since there will
be an impact to Workers Comp and other insurances, it is a case that this
Committee should be cognizant of and be prepared to respond to inquiries
from the RPPTL Section and possibly other groups.  If possible, read the
case prior to the call.

We will also address the Insurance & Surety Committee's presenting a seminar
on Cyber Insurance and related topics at next year's RPPTL Annual Meeting in
June 2015.  We are in the beginning stages of planning the seminar and are
looking for topics and speakers.  Everyone's input is welcomed and if you
want to get involved in the seminar, please let us know.
