<p class="MsoNormal"><span style="font-size:14.0pt;color:#993366">What you are citing is Virginia code. I had a PHA try to put in a similar clause in their lease. Because it was subsidized housing I had it stricken because it added to the tenants rent violating
the U.S. Housing act’s income to rent ratio. The theory is that the insurance increased the rent which is calculated at 30% of income . Adding any mandatory insurance violates the income to rent ratio. I believe the same argument is true in section 8 housing.
I do remember doing some research and most of the companies that are trying this in Florida are shifting the landlord’s liability onto the tenant.
