[RPPTL Leasing Committee] Source of Income lawsuit threats

One of my clients just got hit with one of those threat letters and unsigned lawsuits for saying that they do not accept Section 8.  A tester had called them.   The issue though is that in their county, Source of Income is not an additional protected class.

Is this any sort of violation of Bar rules?  I’ve seen many of these letters and sample lawsuits sent before when a housing provider had a blanket “no felony convictions in the last 7 years” policy but in this case, if SOI is not a protected class, the housing provider is not required to accept Housing Choice Vouchers.

This whole thing seems off.   The attorney sends out a demand letter by email saying “we will be forced to file the enclosed lawsuit… if we do not hear from you” and attaches the “lawsuit” as a PDF named “1945-001- Fair Housing Complaint”
