In my opinion it is retaliatory if the landlord just intends to rent to another tenant. If would not be retaliatory if there was a change of use. Landlord wanted to move into the unit or the unit was sold.

Residential tenant sues landlord in a personal injury lawsuit. Now, landlord does not want to renew the lease. Do you think this falls under retaliatory conduct in Fla. Stat. 83.64? It’s not specifically listed, but the list is not an exhaustive list. Also, if it is considered retaliatory, how long does the landlord have to keep renewing? Something does not seem right to me that a tenant can simply file a PI case against a landlord, and now the landlord is stuck with this tenant indefinitely.

Any thoughts would be appreciated.
