This provision and the companion version in the non-residential statute that we wrote in 1995 help keep the nuisance defenses out of the court while tenants occupy rent free.  They have to ‘pay to play.’

Another no vote here. There are three bad bills out there now. All strike the requirements relative to posting $ in the registry or forfeiting a defense. But, one includes a right of first refusal if the unit is to be sold, essentially imposes rent control across the board and prohibits “discrimination” based upon things like credit score and criminal background (among other horrors.) these ALL need a swift death.

I can assure you that this will be vehemently opposed by the Florida Apartment Association and also the National Association of Residential Property Managers which has a number of chapters in Florida. Most of the members are our clients as well.
