At Greenspoon Marder, Peter Siegel and Alejandro Leiva are currently defending many ADA claims throughout the country (against brick and mortar facilities and websites). The reason why New York has become such a hotbed for accessibility-related litigation is the availability of additional damages which are not otherwise obtainable under the ADA. Specifically, in New York (unlike, for example, Florida), ADA plaintiffs have been able to successfully plead claims under New York State and New York City human rights laws which provide for compensatory damages in addition to injunctive relief. On the contrary, the remedies available under the ADA are limited to injunctive relief, attorneys’ fees and costs.

My clients are being hit with these lawsuits for not having their website compliant with the ADA/FHA as it pertains to the sight impaired.

Are there any real experts out there taking on the defense of these cases?

The attorney is filing a TON of them and most people are settling so no good law or precedent is being created.

I can show you a sample redacted pleading if you want to look at one.  The Supreme Court has just ruled in the Dominos case and this is big stuff now.
