Hello Carlos.  When I looked in Westlaw, there was only one case cited, but under “Citing References” it listed (85).  I pulled the first one, Perkins v. 2018 WL 3931860, *2, M.D.Fla, a case at the motion to dismiss stage.  It found the allegations sufficient to state a cause of action.  It linked to another, Floyd v. City of Sanibel.  It may take a while following the bread crumbs but perhaps you can find some cases that way.  I looked at a few and it appears that it is a statutory cause of action or a defense to eviction, the main issue being what needs to be alleged to constitute “retaliatory conduct” to survive the pleading stage.  I also found some information in Fla. Jur. 2d, which might help.  It is attached.  Good luck.

Team:

Can a tenant bring a cause of action against a landlord for retaliation under 83.64?  I have been unable to find any case law on it.  If so, does anyone have authority they can point to confirming.  Also, could that action be for damages or would it be solely injunctive relief to prohibit the retaliatory conduct?
