[RPPTL LandTen] Proposed Revisions to 713.10

We will discuss the process at our next meeting.  Once the involved committees, Real Property Division and the entire RPPTL Section Executive Council approves the revisions, our Section's legislative professional will work with the sponsoring Legislator for the Bill review and approval process in the upcoming session in Tallahassee.

As many of you know by way of extensive discussions during our past Committee meetings, our Committee, together with the Construction Law Committee, prepared revisions to Sections 713.10 and 713.13, Florida Statutes.  The Bill (SB 1196) was signed into Law by the Governor on June 21st.  Attached in PDF format is the final version.  However, some concern remained as to whether the new changes fully address Everglades Electric case concerns.

Accordingly, through the diligent efforts and guidance of Art Menor and his contacts with the Construction Law Committee, a "glitch" bill has been proposed to resolve remaining concerns.  The explanatory White Paper and the suggested proposed edits to 713.10 are attached.

We will request the Committee's approval of the attached proposed revisions to 713.10 at our upcoming August 4th meeting and Art will be available to respond to any questions at that time.      Meeting notices will go out shortly.
