Subject: 9th Circuit Forest Roads Point Source Meeting
Dear Unit Chairs, Policy Chairs and other interested SAF members:

Many of you have heard concerns from members regarding the recent 9th Circuit Decision (NEDC vs. Brown (Oregon Dept. of Forestry)) stating that forest roads and ditches are a point source of pollution, not exempt under the Silvicultural Rule and must now obtain NPDES permits for storm water runoff from roads. This decision could have a significant impact on forest roads within the 9th Circuit (California, Alaska, Oregon, Washington, Idaho, Montana) and possibly the entire US. It is possible that a NPDES permit could be required for every forest road. At this time, attorneys, EPA and other agencies are still reviewing the decision and trying to determine the next move. This will impact public, state, private and other forest lands.
Because of the concern over this issue, SAF is holding an informal meeting at Convention. Greg Corbin, SAF member, forester and attorney with Stoel Rives in Portland, Oregon will give a quick briefing on the case and will be available for questions. We will then have a broader discussion of this decision and SAF’s potential actions. For more information I have attached a briefing paper written by the law firm Stoel Rives (this is not an SAF product). Any and all are invited to participate.
