<html><body><span style="font-family:Verdana; color:#000000; font-size:10pt;"><div>Query: I have a General Contractor (fully licensed in FL) who has a relationship with a foreman that is NOT licensed. The Foreman is well connected in the insurance industry with LOTS of referrals. The GC wants to create a relationship with the foreman whereby he gets the referrals and they share costs and profits 50/50 but he does not give up control. What is the best way to accomplish this?</div>
<div> </div>
<div>A. independent contractor relationship whereby GC hires foreman's company as a foreman (does the foreman have to be independently licensed for this arrangement?)</div>
<div>B. Employment agreement (I don't like this idea because all money going to employee is taxable)</div>
<div>C. mixed employment agreement plus 20% stock (upon break up how do you get the stock back?)</div>
<div>D. construction manager - licensure required?</div>
<div>E. other -do you have a better idea?</div>
<div> </div>
