<html><body><span style="font-family:Verdana; color:#000000; font-size:10pt;"><div>Interesting statute....but the way the statute reads ..it seems to me that al there will be is more work for the clerk and more contested battles over the notice that is to be filed with the Clerk (the Notice of Unpaid Balance). It will create a mess for title examiners and now we are all going to arbitration? On a residential case, I don't want to have my contractor forced to arbitration (I do better in court); and I certainly don't want my contractor to be forced to file a bond to cover the counterclaim for defective work which naturally arises in every case, whether justified or not. I don't like it. What am I missing? please help me to understand?</div>

The next time we hear about that we may want to look at something akin to what New Jersey implemented in January, 2011, copy attached. <o:p></o:p></div>
