Happy Saturday, everyone, and I hope that you had a great Semiquincentennial of the formal adoption of the Declaration of Independence by the Second Continental Congress –

The regular monthly meeting of the Construction Law Committee will occur on Monday, July 13, at its normal hour, 11:30 Eastern / 10:30 Central. There are no World Cup games on Monday, so you won’t be missing anything by attending the meeting! The first Semi-Final game will be Tuesday at 3 Eastern. France looks to be hard to beat, but perhaps Spain will find the secret recipe. It’s not as if the two countries haven’t done battle a few times before going all the way back to the Italian Wars in 1494-1559.

Next month, our CCNA/P3 legislation will be up for a vote at the RPPTL Section Executive Council meeting. There’s going to be one slight and non-substantive tweak in that the public records exemption part of the bill is going to have to be split off into a separate bill and separate vote for various process related reasons. The public records part requires a higher passing majority at the Executive Council and is more cleanly a standalone bill. We do not expect any significant opposition. This revision does not require any action on our part as the substance is unchanged.

The minutes from our June meeting are attached, as is the Agenda.

Our CLE this month is another Section CLE entitled Bandklayder: A Major Shift in Calculating Construction Damages or No Big Deal: Part 2 - The Wrath of Pre-Judgment Interest
for which you’ll need to register separately. This course will address recent case law on the calculation of construction law damages, with a focus on the impact in calculating pre-judgment interest. Todd Demetriades will present an interpretation of the case law evolution from the plaintiffs' side, while David Salazar will argue an alternative interpretation from the perspective of the defense. This is Part II of the successful CLE from a few months ago on damages. We will, as before, adjourn our meeting in time for people to jump over to the CLE. As a reminder for why we’re doing these semi-separate CLEs, the Section requested that we host several Section CLEs, and that’s why we’ve had some of these this year. Put simply, the Section recognizes that we put on great CLEs and it’s an honor to be asked to do these, even though it may be slightly out of the ordinary for our committee. We did two last “year” and this is the first of the current Bar year. They just happen to be clustered together from last month (last month of last Bar year) and this month (first month of new Bar year).
