CLC members:

There is a recently filed House Bill that has implications for the members of our committee. Specifically, please see HB 255, attached. The proposal is an amendment to Chapter 718 governing condominiums. Specifically, the revision that seems most likely to impact our committee is a proposed amendment to Section 718.124, regarding the tolling of statutes of limitations and repose for condominium associations:

The RPPTL Section is seeking feedback from our committee as to whether we want to elect a formal legislative position. We must respond to the Section by Friday, so this survey will close at 9:00 a.m. on Friday, October 31, 2025.


As many of you may recall, our Committee recently took a position on potential revisions to close gaps in the statutes of limitations and repose on actions arising from construction projects in Section 95.11(3)(b). At the time, one of our committee’s concerns was that there was a potential for a developer to retain control of a condominium association until such time as the statute of repose expires. Section 718.124 was later amended to add the words “and statute of repose,” which mitigated those concerns:

This new proposal seems geared to “undo” that amendment, and again allow the potential for the statute of repose to lapse on claims made by a condominium association prior to turnover of the association to the members.

All of the above being said, if you can spare two minutes or less to complete the Google Form linked above, please do so, so that we may advise the Section of our Committee’s position (if any) on HB 255. This may also be discussed at a future CLC meeting or Legislative Subcommittee meeting (please reach out to Ryan Sullivan and Nick Elder<mailto:ryan.sullivan at hwhlaw.com;%20nelder at cobbgonzalez.com> if you want to be included on the coordination of the Legislative Subcommittee meeting).
