 I have a Florida based client who contracted via email exchanges and phone calls with an Indianapolis based company for the manufacture of a full sized regulation basketball court and 2 smaller practice courts. There was an agreed upon  “no later than” date courts were to be delivered which the seller busted.  Seller covered cost for substitute court for the date needed, but when ordered courts did arrive, they were improperly manufactured (in China, of course).  After I put seller on notice and claim for damages suffered, seller filed in Indiana state court a dec action questioning its liability and claim for unjust enrichment (cost for covering temporary floors).
