[RPPTL-constructionlaw] December 11 2023 CLC Meeting (ADR Subcommittee materials)

Good afternoon, Attached are the cases referenced by Bryan Rendzio and Reese Henderson in today’s subcommittee report. Below is a synopsis of each case.

1.  Alexander v. Quail Pointe II Condo, 170 So. 3d 817 (Fla. 5th DCA 2015):
This case discusses the fact that it is not excusable neglect to justify relief from Judgment when the parties use their own version of a Non-Binding Arbitration Order that does not follow the Circuit Court form and fails to outline the 20 day requirement.

2.  Stowe v. Universal Prop. & Cas. Ins. Co., 937 So. 2d 156 (Fla. 4th DCA 2006):
In this case, the Court found that a request for trial de novo was non-complying where it was served after the arbitration hearing, but before the written decision had been served. The Court discussed the fact that a request for trial de novo that is served when the "window" is closed, whether too early or too late, is ineffective and will be denied.
