CLC’ers:

The Section is seeking volunteers to provide short memos or self-shot videos addressing issues affecting our practice areas caused by the Covid19 pandemic.  Examples of topics relevant to construction could include the application of force majeure clauses, highlighting the impact of various executive orders on construction projects in a given area, and so on.

Good morning, All:

COVID-19 presents numerous issues in our substantive areas of practice that most of us have not dealt with before.  We believe the Section is uniquely situated to provide information to our members on these emerging issues.  We intend to do so in two ways: 1) Short, bullet point style memos and 2) self-shot cellphone or webcam videos.  The memos should be short: whether in paragraph, bullet or question and answer format.  The self-shot video should be 5 minutes or less and will be uploaded to the Section’s YouTube page.  Neither format will likely be eligible for CLE credit, since they are so brief.  These will be disseminated without charge to each member of the Section.

We are looking for tips, pointers, warnings, highlights of executive orders, etc. stemming from the COVID-19 pandemic that effect our practice areas as of right now. Ideas could address: leasing; rent abatement/evictions; whether community associations can close community amenities; fiduciary investments; whether force majeure clauses apply; loan covenant compliance; obtaining effective estoppels; insurance protection; effective notice to beneficiaries; tips on working from home; impacts on construction progress; financing and whether lenders feel “reasonably” insecure; etc.
