Folks,

This is a reminder of the Joint Meeting of the Construction Law Committee and Insurance and Surety Committee this Friday, February 23, 2018, from 12:30 PM - 2:30 PM.  Attached is the agenda for our meeting.  Also attached is a calendar invitation that you should be able to open and "copy to your calendar" as a reminder.

The meeting will begin with the following free CLE presentation which is expected to last approximately one hour (materials for the presentation will be distributed separately prior to the presentation):

Altman Contractors Inc. v. Crum & Forster Specialty Ins. Co.: Balancing the Interests Surrounding Potential Insurance Coverage for Chapter 558 Notices of Claim
Presented by: Reese J. Henderson, Jr., Esq., B.C.S., of Gray Robinson in Jacksonville, FL.

This presentation examines the Florida Supreme Court's decision in Altman Contractors, Inc. v. Crum & Forster Specialty Ins. Co., 2017 WL 6379535 (Fla. December 14, 2017), which determined that a Chapter 558 notice of claim of a construction defect constituted a "suit" within the meaning of a general contractor's commercial general liability insurance policy. The presentation also examines the competing public policy and practical considerations leading up to the court's decision and addresses the practical implications of the court's ruling for insurance and construction practitioners.

You may attend this meeting "in-person" or by teleconference (see call-in information below).  It is taking place in conjunction with the executive council meeting in St. Augustine, FL.  If you're in the St. Augustine area, I hope you will consider attending our CLC/ISC meeting in person on Friday.  You also are invited to attend most of the other committee meetings on Thursday or Friday, so I'm attaching the current meeting schedule for all of the committee meetings in case you're interested in attending any of them.

P.S. - following are the other various educational presentations occurring at in-person committee meetings in St. Augustine in case you are interested:


1.       At the Government and Land Use Committee meeting on Friday from 10:00-11:30 in San Marcos, Jason Teal, Deputy General Counsel for the City of Jacksonville, will be presenting "Local Government Code Enforcement Issues." This presentation will provide a general overview of code enforcement (e.g., notice, opportunity to correct, due process), will discuss types of liens, and will explain the practical and legal limitations on lien forgiveness by local governments while detailing "creative" approaches to resolving liens.

2.       At the Joint Commercial Real Estate Committee and Real Estate Structures & Taxation Committee meeting on Friday from 12:30-2:30 in Government House (across the street from the Casa Monica), there will be two presentations:

a.                   On behalf of the Commercial Real Estate Committee, Gisela M. Munoz, a shareholder at the Miami office of Stearns Weaver Miller, will be presenting "Mindfulness and the (Ethical and Professional) Practice of Law." The nexus of Mindfulness and the practice of law has recently been gaining traction in the legal field, including through the establishment of law school courses, in professional development training/coaching, and in wellness programming at law firms. However, many lawyers are still unclear as to what is meant by "Mindfulness" and as to its potential benefits. Although they are not the point of engaging in Mindfulness, those potential benefits or positive "side effects" can certainly be significant, if not transformative, and may include stress reduction, increased focus, and enhanced communication skills. This CLE program will define Mindfulness, discuss several medical studies about the effects of Mindfulness on health, and explore the intersection of Mindfulness with the Florida Rules of Professional Conduct and other professionalism matters, including unconscious bias, as well as the potential "side effect" of Mindfulness in improving the practice of law substantively/more generally. A 1 hour CLE ethics credit has been applied for.

b.                  On behalf of the Real Estate Structures and Taxation Committee, Mike Bedke (Committee Chair) and Jim Shimberg, the General Counsel and Executive Vice President of Strategic Property Partners, will present "The New WELL Building Standard: Fad or the Future?" The WELL Building standard is receiving a lot of discussion within the building industry but is not familiar to most real estate practitioners (notwithstanding the fact that it is supported by many of the players behind LEED and by Bill Gates and Jeff Vinik, the developer of the new Water Street Project in Tampa). Attendees will learn everything they need to know in order to have a working knowledge of the new standard. Mike will provide an overview on WELL and Jim will speak about the Water Street Project in Tampa, a $3 billion project that will be the first WELL Community certified project in the world. You may then decide for yourself whether or not WELL is "the next big thing!"

3.       At the Real Property Litigation Committee meeting on Friday from 1:00-3:00 in Flagler III, Marty Solomon, a shareholder in the Tampa office of Carlton Fields, will present "Thirteen Ways to Improve Your Writing." This presentation will provide both general tips on tightening persuasive writing to courts in litigation, as well as specific recent developments in legal style and formats. As the courts evolve in their electronic filing, document management, and form of review of pleadings, legal styles and formats are adapting to keep up. Discussion will include references to some of the leaders in legal writing to follow. This presentation has been approved for 1 hour of CLE credit.
