Lee,

My RPPTL Litigation Committee team is teaching an E-CLE next week that is based on the recent 4th DCA opinion in Flinn v. Doty. Can you recommend someone from the Construction Law side that I might contact to bounce a few questions off of.  Our conclusion is that the fraud and egregious conduct standard from Havoco only applies under an equitable estoppel legal theory and that equitable liens based on an unjust enrichment theory have no such requirement. The questions arise when you look at a construction equitable lien fact pattern, for example that in Rinker Materials and ask what would happen if the contractors had pursued an equitable lien based on unjust enrichment.
