Folks,

This is a reminder that our next monthly call is scheduled for Monday, May 16, 2016 - beginning at NOON.

Attached are the following: (1) Agenda for Monday's call; (2) Meeting Minutes from our April 18, 2016 Meeting; and (3) Presentation materials for Monday's CLE.

The speakers for our meeting on Monday, May 16, 2016, will be Mr. Daniel A. Thomas and Mr. Alan B. Rose, Shareholders with Mrachek, Fitzgerald, Rose, Konopka, Thomas & Weiss, P.A., out of their West Palm Beach office.  They will speak to the Committee about an interesting case and decision recently out of the Second District: Hiller v. Phoenix Associates of South Florida, Inc.  The Hiller decision examines in detail the interplay of statutes governing surety transfer bonds and notice of contests of construction liens.

--- and as a legal teaser for Monday's presentation: when can a Florida District Court of Appeal effectively overrule a Florida Supreme Court case? HINT: The answer isn't "Never."

Mr. Thomas is Florida Board Certified in Construction Law and focuses on construction defect claims. He serves as a member of the American Bar Association's Forum on the Construction Industry and Construction Litigation Committee, and The Florida Bar's Construction Law Committee.

Mr. Rose is Florida Board Certified in both Business Litigation and in Appellate Practice. He concentrates his practice on the litigation and appellate practice involving business disputes, including partnership and corporate shareholder disputes, contracts, securities and class actions, and bankruptcy and creditor's rights.
