CLC ADR Committee Report April, 2015


CLC ADR Subcommittee members Bill Christopher and Melinda Gentile met on April 13, 2015 with Brent Zimmerman, the CLC Webpage Liaison, to discuss the mechanics of posting the proposed CLC ADR Online Directory of Mediators and Arbitrators who have experience in construction law

The Subcommittee recommends that the listings in the Directory will be voluntary by the mediators and arbitrators, and that the Directory will be posted or accessed through the CLC and the RPPTL webpages. The Sub-Committee would like the Directory to be accessible to the public and searchable, without any password protection.  The initial goal is for the Directory to be a searchable spreadsheet with hyperlinks to webpages imbedded within.


With regard to content of the Directory, the Subcommittee recommends the following specific search criteria fields:

            1. Name
            2. Address (limited to City/State)
            3. Phone
            4. Email
            5. Webpage address/hyperlink to Webpage
            6. ADR Provider Panels (i.e., AAA Construction Panel, AAA Large Complex Case Panel, AAA Mega Project Panel, ICDR, JAMS, CPR Construction Panel, ICC, CIArb, FDOT DRB)
            7. Florida Supreme Court Certififed Circuit Court Mediator Y/N
            8. Florida Supreme Court 4 hour arbitration qualification course Y/N
            9. Florida Bar Board Certified Construction Lawyer Y/N
            10. Other Florida Bar Board Specialty Certifications
            10. Languages spoken fluently
            11. Professionals Credentials (i.e. P.E., FAIA, Florida GC, FCIArb, American College of Construction Lawyers, College of Commercial Arbitrators, American College of Real Estate Lawyers)
            12. Undergraduate School major and Degree
            13. Graduate Schools and Degrees (not law school)
            14. Faculty - name of institution and subjects taught




This information is intended to assist CLC members identify  mediators and arbitrators whose experience and qualifications match the needs of a particular dispute. The Directory will rely on self-reporting, as we do not have the manpower to verify the information furnished. The Directory will be accompanied by a disclaimer to that effect.


The Subcommittee requests the approval of the CLC to survey the entire CLC membership as soon as possible, and invite the CLC members to complete a form (which may be in GoogleDocs format or similar) to provide the data needed for the Directory if they elect to be listed.  We would like to see the initial version of the Directory go live before July 1, 2015, and we recommend that it be updated annually.



The technical requirements of the project may require that initially we roll out a simpler version of the Directory, while we continue to enhance and upgrade its features. If we can acquire the services of an unpaid intern, that would be greatly appreciated.
