[RPPTL-constructionlaw] CLC Special Meeting - SB 460

CLC Members,

As an update to all CLC members regarding the special meeting for SB460 - the meeting was called to order at Noon on Wednesday 1/22/14 and, after discussion of the Bill, a vote was taken and it was unanimously agreed that the CLC should take the position of opposing SB 460 as currently drafted.

I note there was some discussion about a possible future amendment to the Bill language, but unless and until that happens and we know exactly how the language has been modified, the CLC's position will remain in opposition.  Stay tuned because if there is an amendment to the Bill, further action may be necessary.  I will keep you posted.

All,

A Senate Bill (SB 460) has been filed which would increase the cost of recording a claim of lien and modify the provisions relating to the recording of a claim of lien under Section 713.08, Florida Statutes.  Attached for your convenience is a copy of the Bill.  The legislative subcommittee of the CLC has discussed and vetted these proposed changes and unanimously recommends the CLC oppose SB 460.

For purposes of establishing the position of the CLC as a whole that we can include in any ultimate recommendation to the RPPTL Section, I am calling a special meeting on Wednesday, January 22, 2014 at Noon, where CLC members will have an opportunity to discuss the Bill and then we will ultimately take a vote as to whether the CLC should: (1) Oppose the Bill; (2) Support the Bill; or (3) Take No Action.
