The link below is to a decision issued by the United States Court of
Appeals for the Fifth Circuit issued earlier this week which ruled that
venue provisions of federal law override required venue clauses in a
contract. To me this is a particularly interesting case as it as
vigorous concurring opinion that reads more like a dissent and
recommends the decision be appealed to the Supreme Court based on a
split in the district with the majority of circuits deciding the same
way as the Fifth.
Given the significance of this issue for all who work with the Miller
Act, I strongly recommend you review the case. The case is: In Re
