A great point Michael.  It  would also be nice to distinguish lien
foreclosures from various local foreclosure rules and procedures which
typically involve a mass of forms largely inapplicable to lien foreclosures.
However, not sure if this can be addressed at the state legislative level.

Any chance we can add a provision distinguishing foreclosing lienors from
foreclosing lenders for purposes of the AAA-like filing fees now charged by
the courts in lien foreclosure suits?

CLC:  As many of you have noted, the proposed Florida Fair Foreclosure Act
that I distributed to the CLC yesterday for comment contained language which
would have repealed 57.105.   See below an email from Jerry Aron clarifying
the issue.  Many thanks to Larry Leiby and Reese Henderson for their efforts
in quickly reviewing the proposed act and brining this issue, and a few
others, to Mr. Aron's attention.  To paraphrase Donna Summers (arguably the
Queen of disco); your CLC is working hard for the money.  Arnie.

My apologies to all, but the draft that was distributed had an error in it
and it is likely to get a lot of people excited. Line 20 was mistakenly
added by someone outside of the committee. There is absolutely no intention
to delete or diminish 507.105. If you have already distributed this to your
committee would you please let them know to disregard line 20.pretend it is
not there. If you have not distributed it, please let them know in your

Section's Ad Hoc Foreclosure Reform Committee has been working with Reps.
Kathleen Passidomo and George Moraitis to develop legislation to address
some of the issues with foreclosures in Florida.  You are receiving this
