GC strikes purchase order for building materials with established supplier with 50% deposit required back in November 2021. Similar to RE closings frauds, someone intercepts emails involved and provides same bank but different account routing info for wiring funds. Owner’s lender wires funds, per GC’s instructions, confirmation emails from supplier received, and DocuSign releases received for deposit amount with familiar signature shown from Supplier’s accounting dept. Upon inquiring on current delivery dates this week, Supplier now claims it never received the funds, never sent confirmation emails (explaining maybe a hack occurred, but hasn’t explained those releases yet), and never started production of custom materials. Obviously, GC is now in bind not only on construction schedule, but on who is liable for the now-claimed missing deposit funds. GC doesn’t have cyber fraud insurance. Need attorney to advise this GC.
