CO. sues OWNER multiple times in name of "Bank Name One" --> and then in the name of "Bank Name Two" (assignee). Total number of foreclosures = 3 or 4....</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">Each and every case was either voluntarily or involuntarily dismissed. </span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><u><b>FIRST FACTUAL ASSUMPTIONS</b></u>: The most recently filed/dismissed case constitutes the: </span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">1. Second Lawsuit in the name of "<i>Bank Name Two</i>" and</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">2. Second time that "<i>Bank Name Two</i>" took a voluntary dismissal.</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><b>First Legal Conclusion Based on First Factual Assumptions:</b> If same-name-Plaintiff sues same-name-defendant on same-mortgage and on same-legal description, then the second <b><i>voluntary dismissal</i></b> equals an <i><b>adjudication on the merits.</b></i></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><u>TWO MORE FACTS AND THEN MY QUESTIONS:</u> </span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">ADDITIONAL FACT NUMBER ONE: It is possible that <b><i>Bank Name One</i></b> sued on the <u><i>same-mortgage</i></u> against the <u style="font-style: italic;">same-property.</u> before they assigned it to <i style="font-weight: bold;">Bank Name Two</i> <i>and</i> had taken a voluntary dismissal on that lawsuit. (this means that it is possible that instead of dealing with a factual scenario where we have the same-named Plaintiff filing both the first and second voluntary dismissals, we have Bank Name One filing foreclosure suit and voluntarily dismissing it, then assigning the loan to Bank Name Two who then, as an Assignee, sues on the same exact same loan/mortgage and takes a voluntary dismissal)</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">ADDITIONAL FACT NUMBER TWO (here is where I hope it gets interesting!) - Possibly "before", and most definitely "after" the most recent lawsuit suffered death by voluntary dismissal filed by <i style="font-weight: bold;">Bank Name Two</i> said <b><i>Bank Name Two</i></b> had <b><u><i>force-placed insurance on the house</i></u></b> . The roof is crap and needs repair....its leaking and the ceilings are caving in. A claim is made upon the insurance. Insurance Company pays 100K on the claim. Guess Who the Payee Is! YES! The Mortgage Company! I want to file a Quiet Title Action and demand the money back from the Mortgage Company to pay the roofer who is already up there fixing the roof. If there were two lawsuits filed, both in the name of Bank Name Two against the Defendant (my client), for $$$, principal, interest, court costs, fees, insurance, taxes, etc.; that on filing of the second voluntary dismissal equals an adjudication on the merits and the mortgage is DEAD such that I may now file a quiet title action asking a Judge to wipe out the lien?</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">2. If the mortgage was first foreclosed on by Bank Name One against my client (and others who are now dead); then it is assigned and there are Lawsuits ##2 and 3 filed - both ending in Voluntary dismissals, should not the second lawsuit's voluntary dismissal been an adjudication on the merits?</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">3. The best that the mortgage company can demand after their mortgage is dead is to recover the premiums they paid after the last lawsuit was voluntarily dismissed. They cannot keep the 100K in insurance proceeds as contractual protection of their collateral because they no longer have collateral to protect under the two - dismissal rule, correct?</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">4. If the mortgage company (Bank Name Two) were to sue to foreclose on the mortgage today, <i>they would have three problems I am hoping you will agree???</i>: (1) the case was dead after the second of three voluntary dismissals; (2) the case was dead after the third of three voluntary dismissals; or the statute of limitations has run because the last time the Defendants paid on the mortgage was 2003.</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">5. If my client demands the proceeds of the force-placed insurance to fix the roof, does she (a) waive anything? (b) revive anything? May she demand it or is she better off not?</span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;"><br></span></div><div><span style="font-size: 14pt;" mce_style="font-size: 14pt;">LAST QUESTION: ANYONE WANT TO CO-COUNSEL WITH ME ON THIS? It will be a PALM BEACH LAWSUIT. My clients are having a hard time with money. Once the lawsuit is won and the title is quieted, the property will be worth between 400,000 and 700,000 clear.
