However, someone did make a comment if there is a need to increase the
bond.  That is where the problem may arise.  The lender is not a
party to the case so when the contractor comes into court requesting an
increase in the bond—the person who put up the bond is not there.  Judge
cannot compel a non-party to put up more money and the contractor may end up
under-secured.   <o:p></o:p></span></p>

Florida is considered a “lien” state and case law has held that a mortgage is
not a transfer of “interest” in real property and therefore does not need two
