Folks

Many practitioners are waiving motions by not being able to have the motions scheduled for hearing within 45 days of filing. This is because many of the administrative orders around the State provide that the motions are waived if not actually heard within 45 days and many of the busy judges do not have sufficient time to hear the motions. The proposed rules seem to make matters worse by requiring busy judges without  sufficient time to hold a hearing to extend the 45 days when they already do not have the time.

Comments are due in about 6 weeks and hopefully many of you will provide your input.  Also I would appreciate if you share the attachment with as many judges as possible to get more input before the Rules are changed.
