This was cleared up by the addition of sub-section 4 to section 34.01 a number of years ago which gave county courts equity jurisdiction:

(4) Judges of county courts may hear all matters in equity involved in any case within the jurisdictional amount of the county court, except as otherwise restricted by the State Constitution or the laws of Florida.

I believe there is a case holding that County Court has concurrent jurisdiction with Circuit Court to foreclose liens within their jurisdictional limit (at the time under $15k).   Accordingly, for liens under $30k, you ought to be able to file in either County Court or Circuit Court and have the Court vested with jurisdiction to handle the matter.

But...what are folks doing with

liens less than $30k?

Circuit (chancery) and 26 or

the new jurisdictional limits

that say $30k below???

Can’t find any direction.

Don’t want to incorrectly file

and have the year run and

That’s procedural.  It happens with every House Bill that has been approved by the House and sent to the Senate.  The problem is no Senate Committees are continuing to meet. That’s why the Senate Bill (SB 868) and HB 283 are effectively dead.

My legislative tracker shows that the HB 283 Lien Law Bill has been referred to three Senate committees as of today. It seems to suggest that the HB 283 has not yet died in the Senate. 

 

Can you confirm that I am correct that it has not died?
