[CLC-Discussion] Can an Association be a successor in interest to a Developer's rights under a General Contractor's Performance Bond?

Following turnover of a condominium, canan  Association become a successor in interest to the Developer's rights under the General Contractor's performance bond?  I am dealing with an Association that claims that it has stepped into the shoes of the Developer, and that the General Contractor and Surety are in breach of the performance bond due incomplete and defective work, which was put them in default.  There has not been an any written assignment of rights by the Developer.
