Hardy, no, lien foreclosures are normally assigned throughout the other divisions. If you check the "foreclosure" block on the civil cover sheet it could, however, get assigned to the foreclosure division by mistake.

Subject: [CLC-Discussion] 15th Circuit's Administrative Order in Foreclosure Division

Folks,

The attached administrative order in Palm Beach/15th Judicial Circuit Court's "foreclosure division," provides that motions directed to the pleadings are deemed abandoned without court order if not set for hearing in 60 days. The opposing party may then seek a judicial default.

Anyone know whether foreclosures of construction claims of lien get assigned to the "foreclosure division" in the Fifteenth Judicial Circuit?

Hardy

Dear Committee Members

The attached Palm Beach County Administrative Order regarding motions that prevent cases from being at issue, and providing for automatic disposition, may be of interest to litigators, especially in Palm Beach County. Others may desire to have their circuit's chief judges adopt similar rules.
