Subject: Florida Supreme Court's decision yesterday regarding implied warranties
Folks,
Please find enclosed a copy of the Florida Supreme Court's decision yesterday in Maronda Homes. The Court holds that "implied warranties of fitness and merchantability apply to the improvements that provide essential services to the" homeowners' association (i.e. retention ponds, underground pipes and drainage systems built by the developer).
