I haven't read the statute in a while, but I believe that the owner
simply needs to comply with notice to contractor in order to sue.  So if
the contractor doesn't respond, the owner only need wait the statutory
period before filing its suit.

Can anyone tell me the practical effects of failing to respond to the
notice of defect? (if entity receiving notice does not want to inspect
or fix the problem)
